RMXY-1 is licensed to you through the App Store. What you make with it is yours. Please keep your volume safe.
- Apple's standard licence applies
- You own your audio, scenes and programs
- Your consumer rights are not affected
- Dutch law, with your local protections intact
Agreement
These Terms of Use apply to RMXY-1, an app for iPhone and iPad published by Borja Deudero Gracia under the Random Machines name (“we”, “us”). By downloading or using RMXY-1 you agree to these terms.
RMXY-1 is distributed through Apple's App Store and licensed under Apple's Licensed Application End User License Agreement (the “Standard EULA”). These terms add detail for RMXY-1. If they conflict with the Standard EULA, the Standard EULA prevails.
Your licence
You may install and use RMXY-1 on Apple devices that you own or control, as permitted by the App Store's usage rules. The app, its sound engines, design and documentation remain ours. You receive a licence to use them, not ownership.
Your work
Audio you process or record, and the scenes, programs and settings you create, belong to you. We claim no rights in them and never receive them. You may use sounds made with RMXY-1 in your own music and performances, commercial or not.
You are responsible for having the rights to any audio you bring into RMXY-1.
Acceptable use
Please do not copy, redistribute, resell or modify the app, or reverse engineer it except where the law expressly allows you to. Do not use RMXY-1 to infringe the rights of others or in breach of applicable law.
Host apps and third-party plug-ins
When RMXY-1 runs inside a host app as an AUv3, or when you load third-party AUv3 effects into the standalone app, those products are provided by their own developers under their own terms. We are not responsible for them, their availability or their behaviour.
Hearing and equipment
RMXY-1 is a performance instrument. Feedback, resonators, generators, randomization and high dry/wet settings can produce loud or sudden sounds. Start at a low volume, especially with headphones or amplified systems, and raise it gradually. Keep a way to stop the sound, such as BRAKE or your mixer, within reach.
Purchases and refunds
Payments, if any, are processed by Apple. Refunds are handled by Apple under the App Store's terms. Where the law gives you a right of withdrawal or refund, you can exercise it through Apple.
Updates and availability
We improve RMXY-1 over time. Updates may add, change or remove features. We aim to keep your scenes and programs working across updates, but we cannot guarantee that every older file or feature will be supported indefinitely.
Warranty and liability
We build RMXY-1 with care. To the extent the law allows, it is provided “as is”, without warranties beyond those set out in the Standard EULA. We are not liable for indirect or consequential losses, such as lost recordings, lost performances or damage caused by excessive volume.
Nothing in these terms limits liability that cannot be limited by law, or takes away the rights you have as a consumer under the law of the country where you live.
Governing law
These terms are governed by the laws of the Netherlands. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence, and you may bring a claim in the courts where you live.
Changes to these terms
We may update these terms when RMXY-1 changes. We will publish the new version on this page with a new date. Continuing to use RMXY-1 after an update means you accept the updated terms.
